If insurance agents switch to a competitor company and engage in post-contractual competition, it is not long before the agency premises are ordered to be searched. However, the investigating judges often fail to recognize that the agent has acted lawfully and has not committed a criminal offence.
In its July issue, Wirtschaftsdienst Versicherungsvertreter explains that many criminal charges and search warrants do not even meet the requirements of probable cause because the agent acted lawfully. Wirtschaftsdienst has identified the most common misjudgments in practice.
