The discussion about the future of the legal framework for the automotive trade has become more heated since the EU Commission presented its long-awaited evaluation report on the previous BER on May 28. In the report, the Commission signaled its intention to do without an independent motor vehicle BER in the future.
Robert Rademacher, President of the German Association of the Motor Vehicle Trade (ZDK), emphasized at the ZDK General Meeting in Berlin that the association considers new motor vehicle-specific regulations to be sensible and necessary after the expiry of the current Motor Vehicle Regulation. Otherwise, there is a risk of losing important protective provisions.
In this context, ZDK Managing Director Antje Woltermann refers to the high risks and legal uncertainty that companies in the motor vehicle industry would have to live with without these protective provisions.
Cecra President Professor Jürgen Creutzig also advocates the continuation of an independent motor vehicle BER and emphasizes that the associations will continue to fight for this goal. Professor Jürgen Ensthaler from the Technical University of Berlin warns against the complete abolition of the motor vehicle-specific rules of the BER, as they are essential for a functioning internal market. He also points out that without these safeguard clauses, many small and medium-sized companies would have to give up. Finally, the vehicle prices that the Commission considers to be justifiable are also based on the slow demise of many dealerships.
